Where to Find Canadian Estate Papers
Testaments, wills, property inventories, letters of administration and probate, guardianships, trusteeships, bonds, depositions and other correspondence are included in estate records. Information on wills and letters of administration is found in the records of the court in which the estate was probated. Search fees are charged by some Provincial authorities...others require prepayment.

New Brunswick
Probate files, wills and letters of administration, and probate registers (indexed) are in the Provincial Archives. Microfilming is on-going. These should be available for interlibrary loan from the New Brunswick Provincial Archives.

Registry of Probate in each county is the repository for all estate settlements. Microfilm copies of probate records, which are complete to 1900 for all counties, are located in the Public Archives ..some contain indexes.
Ontario
Those records from 1791 to 1859 of the Court of probate (registers, indexes and files), as well as original files or microfilm of the Surrogate Court Records from 1793 to 1900, are in the Ontario Archives. Indexing of estate files began in 1859 in the Surrogate Court and are arranged alphabetically within each year.
Prince Edward Island
From 1815-1933 Probate Court records are in the provincial archives.
Quebec
Notaries have those which they have passed and keep them until retirement. At that time they are sent to the Court House of the judicial district where the notary practiced. Copies of wills can be obtained from the Judicial Archives of the notary's District, or from the notary who drew them up or from his successor who kept these files. These might contain other related documents pertinent to the settlement of an estate.
